Probate is the legal process that is completed by the courts when a person dies, to organise the estate and distribute it once all debts have been settled, either via the wishes stipulated in the will OR by the laws of intestacy should there be no will in place. This means that if you don’t have a correct will in place, the law decides who receives what, not by your own wishes.
Probate can be complicated and solicitors often charge between 3 and 5% of the total value of the estate to complete this process. For example an estate worth £200 000, the cost of probate could be as high as £10 000.
